Historical waqf raises legal problems when a waqf transaction occurred before the establishment of a modern waqf administration system and was therefore not supported by a Waqf Declaration Deed (Akta Ikrar Wakaf), a waqf certificate, or other formal documents. The issue becomes more complex when the waqf declaration, the legal status of the nazhir, and the waqf property intersect with the administration of State-Owned Property (Barang Milik Negara or BMN), as illustrated by the Blang Padang case in Banda Aceh, historically associated with a waqf by Sultan Iskandar Muda for the benefit of the Baiturrahman Grand Mosque. This study analyzes the legal construction of historical waqf determination through rechtsvinding by the Sharia Court (Mahkamah Syar’iyah) and examines a model for resolving waqf status in relation to BMN administration. Employing a normative juridical method with statutory, conceptual, historical, case, and comparative approaches, the study finds that the absence of an explicit isbat wakaf procedure does not eliminate judicial authority to examine historical waqf.
